What are the Different Ways I Can Divorce a Spouse in New Jersey?

Going through a divorce is never easy. The process tends to require a great deal of time and energy from all parties involved. When going through such a significant period of time in your life, it is important to have the guidance of an experienced New Jersey divorce attorney.

Contested Divorce

Spouses who enter a divorce and are not on good terms may need to complete the process in court through litigation. This is often the case when spouses cite “fault” grounds for their divorce, meaning they want to hold the other responsible for the end of their marriage. Cases such as these may be for reasons relating to adultery, habits of intoxication, abuse, desertion, or prison sentences of 5+ years. When spouses cannot agree to terms of their divorce and need the help of the judge to do so, it is known as a contested divorce. 

Uncontested Divorce

In situations where spouses are able to come to agreements together, it is known as an uncontested divorce. This is commonly seen when spouses cite “no-fault” grounds for their divorce, meaning they are not holding either party responsible for the end of their marriage. In these situations, spouses are not required to divorce in court. Instead, there are other options available to them outside the courtroom, such as: 

  • Mediated Divorce: This allows couples to negotiate the terms of their marital issues with the help of an unbiased third party in an effort to reach agreements that work best for both of them. When arrangements are made, the mediator can present them to court to be approved.
  • Collaborative Divorce: This is a series of four-way meetings where spouses are joined by their attorneys to help settle their future arrangements for their marital issues.
  • Arbitration: While this process also involves a third party, instead of acting as a mediator, they act as a judge. They make all the final decisions relating to marital issues for the spouses.
