This depends on when the student loans were acquired. If you or your spouse obtained student loans before the marriage, then the person who took out the loans will be responsible for that debt. However, if the student loan debt was acquired during the length of the marriage, then this debt would be considered marital property in court. In this scenario, you might be liable for your spouse’s student loan debt even after the divorce is finalized. And vice versa, your spouse could still be responsible for your student loans in the divorce settlement.

CAN I AVOID MARITAL DEBT?

The easiest method is to refinance the loans in just your spouse’s name (or just in your name, if it’s your loan).
