The Divorce Process in New Jersey

  1. Filing the Complaint The divorce process begins when one spouse files a Complaint for Divorce, citing either fault-based or no-fault grounds.
  2. Serving the Complaint The other spouse is formally served with the divorce papers and given a certain period of time to respond.
  3. Case Management and Discovery The court schedules initial conferences and both parties exchange relevant financial and personal documents.
  4. Settlement Negotiations or Mediation Before proceeding to litigation, couples may attempt to resolve issues such as custody, support and property division through mediation.
  5. Trial If a settlement cannot be reached, unresolved matters go before a judge for final determination.
  6. The Final Judgment of Divorce The court will issue a Final Judgment, formally ending the marriage and setting the terms for the divorce.
