What is the difference between a postnuptial agreement and a prenuptial agreement?

Prenuptial and postnuptial agreements deal with many of the same things. To start, they both work to protect assets. If you want to ensure your luxury vehicle is off limits, should you ever get divorced, you can set a provision for this in either a prenuptial agreement or a postnuptial agreement. These agreements can also establish provisions for other financial matters, such as whether one spouse will be entitled to alimony in a future divorce.

That said, the primary difference between prenuptial and postnuptial agreements is that prenuptial agreements are drafted prior to a marriage, while postnuptial agreements are drafted exclusively after a couple is already married. Many spouses are fearful of mentioning to their spouse that they’d like to draft a postnuptial agreement, because, let’s face it, it’s not exactly a “romantic” discussion.
